DOJ to investigate Broken Arrow city council’s denial of Islamic Society of Tulsa mosque rezoning request

The U.S. Department of Justice (DOJ) is investigating the Broken Arrow City Council’s rejection of a proposed mosque development. This investigation stems from the January denial of a rezoning request for a 15-acre site intended for a retail center and mosque, amidst significant public debate in the largest suburb of Tulsa.
The DOJ’s Civil Rights Division is examining Broken Arrow’s zoning regulations to determine if they align with federal law, specifically the Religious Land Use and Institutionalized Persons Act of 2000 (RLUIPA). Federal law prohibits land-use rules that substantially burden religious exercise without a compelling justification, or that treat religious institutions less favorably than non-religious ones. The investigation also considers whether the regulations unreasonably restrict religious assemblies or constitute religious discrimination.
According to a city statement, officials are “fully engaged” with the DOJ. The probe will review the city’s zoning requirements for houses of worship, focusing on the denial of the Islamic Society of Tulsa’s rezoning request. The DOJ letter explicitly noted that the investigation is preliminary, stating no determination of RLUIPA violation has been made yet.
The investigation has requested extensive documents, including potentially up to five years of records, within 30 days, alongside the invitation for officials to submit additional relevant materials. Interviews with city officials are also anticipated. The letter directed the city to preserve all potentially relevant records.
City officials have declined further comment, indicating a meeting in executive session on August 3 to discuss the investigation. Separately, Oklahoma Attorney General Gentner Drummond sent a letter urging the Trump administration to halt the probe, framing it as an example of “federal overreach.” Drummond himself had initiated a state-level review in January citing concerns about the project’s “ownership structure, governance and financing,” the status of which review is not specified.
