In a recent legal settlement, San Diego County has agreed to pay $10 million over the tragic death of 11-year-old Arabella McCormack, bringing the total compensation to over $31.5 million. This settlement comes in response to a lawsuit filed on behalf of Arabella’s surviving younger sisters, which highlighted significant failures in reporting and investigating child abuse prior to her death.
The lawsuit detailed how county social workers did not adequately investigate two prior abuse and neglect claims reported two years before Arabella’s death. Documents from the Child & Family Well-Being Department revealed that school workers had reported controlling behaviors by the McCormack family, including limiting food and water intake, restricting bathroom usage, and forcing Arabella to sleep on the floor as punishment.
A San Diego police officer, LaWanda Fisher, was also implicated in the civil lawsuit. Fisher was accused of failing to report child abuse and directly contributing to the abuse by providing wooden paddles for disciplining the girls. As part of a separate agreement, Fisher agreed to pay $6,000, complete 20 hours of community service focused on children’s issues, and attend a course on child abuse and neglect.
The county expressed its sorrow over the incident, emphasizing its commitment to the safety and protection of children in its care. Meanwhile, Fisher’s attorney stated that she was shocked and devastated by the events and cooperated fully with the related criminal investigation.
