Federal Judge Rules to Move Word of God Church’s Lawsuit Against Richland County Forward

A federal judge has ruled that a lawsuit filed by Word of God Church and Ministries against Richland County can proceed towards a trial. The church claims that the county denied them a fair opportunity to redevelop the Dutch Square Mall in Columbia, alleging that unconstitutional actions by the county caused their project to fail.

Bishop Eric Davis of Word of God Church and Ministries expressed relief at the judge’s decision to deny the county’s motion to dismiss the case. He emphasized that the facts presented were sufficient to warrant a trial, highlighting the significance of fairness in the process. As the lawsuit enters the discovery phase, the church is challenging the county council’s claim of legislative privilege over certain admissions and questions.

The church had entered into a contract to purchase the Dutch Square Mall in 2023 and had developed a proposal for redevelopment, seeking approval from the Richland County Council for funding and property tax abatement. However, the proposal was reportedly not considered by the full council due to objections from Councilmember Allison Terracio, who cited the religious status and character of the church as a barrier. Bishop Davis argues that the rejection was based on the identity of the presenters rather than the merits of the project itself.

The church has filed a motion to compel Richland County to release evidence related to the case, asserting their readiness to engage in the legal process. Richland County has refrained from commenting on the matter, citing ongoing legal proceedings.
