New Apostolic Church Files Lawsuit Against Breakaway Church for Trespassing and Copyright Infringement
New Apostolic Church Zambia has initiated legal action against a breakaway congregation, the True Apostolic Church, alleging trespassing, libel, and unauthorized use of its emblems. The lawsuit was filed in the High Court, seeking a judicial declaration that all church buildings constructed with the plaintiff’s funds and contributions belong to the New Apostolic Church. The claim also includes compensation for alleged copyright infringement and conversion of assets.
The plaintiff asserts that it has been a duly registered and incorporated church in Zambia for over a century, with legal ownership of various properties, including churches built on state and traditional land. The church claims that the breakaway group has engaged in activities that disrupt its operations, including the unlawful occupation of its premises and the use of its symbols without permission.
The New Apostolic Church Zambia alleges that the breakaway congregation has taken over several of its church buildings, including the Besa Congregation in Chipata, the Chizongwe Congregation, the Hilltop Congregation, and the Roadside Congregation. These properties are currently being used for the breakaway church’s activities, according to the statement of claim.
The plaintiff further states that the breakaway church has interfered with worship activities and has been disrespectful to the leadership of the New Apostolic Church. The church seeks an order requiring the defendant to account for any income or payments received from the sale of goods or materials bearing the plaintiff’s logo or emblem.
The legal proceedings highlight the tensions between the main church and its breakaway faction, with the plaintiff emphasizing its legal rights and the need for accountability. The case underscores the importance of respecting legal boundaries and the sanctity of church property, as outlined in Proverbs 18:17, which emphasizes the value of justice and fair judgment in resolving disputes.
The New Apostolic Church Zambia continues to assert its position as the rightful owner of its assets and seeks to protect its members and congregations from what it describes as unlawful encroachment. The outcome of the case may have broader implications for church governance and the resolution of internal conflicts within religious communities.
