The Elim community has secured a temporary reprieve in a legal dispute with the Moravian Church of South Africa, as both parties agreed to pause court proceedings. This allows the community to prepare a more comprehensive case regarding land ownership, which they claim dates back to their historical ties to the land. The Moravian Church had sought court guidance on whether the Overseers Council, representing the community, should be compensated over R1.7 million from lease agreements between 2013 and 2019.

The dispute centers on the rightful ownership of land in Elim, a town in the Overberg district established as a mission station by the Moravian Church in the 1800s. The church currently holds the title deed, while the community, represented by the Overseers Council, asserts they were dispossessed during the colonial period. The community’s counterclaim highlights their long-standing connection to the land and their efforts to reclaim it through legal means.

The agreement reached in court allows the Elim community to gather evidence from residents who have lived in the area for generations, as well as from experts on the town’s heritage. This process aims to build a stronger case for their claim. The community pays a levy of R20 to R150 to the Overseers Council, as they do not pay rates and taxes. The council also collects rent from subsistence farmers on agricultural land.

Advocate Tanya Golden, representing the community, noted that many residents are elderly and sometimes unable to pay the levies. She emphasized that the funds collected by the Overseers Council are used for the development of the town. The community’s representatives expressed a desire for clarity on land ownership, stating they want the town to be in the hands of the people.

The case reflects broader tensions between historical land rights and current legal structures, with the Elim community seeking to assert their heritage and rightful ownership. The legal process continues as the community prepares to present its case with the support of historical and community evidence.
